(N.D.A.C. Section 75-02-02.1-24(3) and (7))

1. The community spouse asset allowance (liquid, personal, or real) is $90,660 effective January 2003 ($89,280 effective January 2002), plus

1. Any additional amount transferred under a court order; or
2. Any additional amount established through a fair hearing.

2. After the institutionalized or HCBS spouse has been determined eligible, the community spouse is no longer subjected to the community spouse asset allowance.
